In April 2022, the Constitutional Court struck down the blanket retention provisions in Ruling 268/2022, finding them in breach of the rights to privacy, data protection, and effective legal remedy under both the Portuguese Constitution and the EU Charter of Fundamental Rights. In December 2023, Ruling 800/2023 refined the court's position further.

A reformed law, promulgated by the President on January 29, 2024, introduced a new framework. Retention of traffic and location data now requires a court order and must be limited to what is strictly necessary for investigating serious crimes. The retention period is set by a judge and ceases the moment the need ends. This replaced the previous practice of blanket retention without judicial supervision.
