Yes. VPN use is fully legal in Ireland. There are no laws restricting individuals from using VPN services. Ireland operates under EU law (GDPR), the Data Protection Act 2018, and the Irish Constitution (Article 40.3, which protects the right to privacy). The Data Protection Commission (DPC) is one of the most active privacy regulators in the EU. As with any jurisdiction, activities illegal without a VPN remain illegal with one.
Ireland reformed its data retention framework in 2022 following a landmark ruling by the Court of Justice of the European Union (CJEU).
The original Communications (Retention of Data) Act 2011 required ISPs and telecom providers to retain all traffic and location data for two years (phone) and one year (internet). In 2022, the CJEU ruled (in a case arising from the prosecution of convicted murderer Graham Dwyer) that this blanket retention was incompatible with EU law.
The Communications (Retention of Data) (Amendment) Act 2022 came into force on June 26, 2023. Under the new framework, general and indiscriminate retention of traffic and location data is only permitted to safeguard national security, requires a High Court order, and is limited to 12 months. Targeted preservation orders for specific individuals under criminal investigation remain available. The Minister for Justice obtained the first High Court retention order on the day the Act commenced.
