On August 26, 2024, the Chamber of Deputies approved Law No. 21,719, a comprehensive reform published in the Official Gazette on December 13, 2024. The new law creates the Agencia de Protección de Datos Personales (Data Protection Agency), expands ARCO rights (access, rectification, cancellation, opposition), requires data breach notification, introduces data protection impact assessments, and imposes fines up to 20,000 UTM (roughly US $1.4 million). It takes full effect on December 1, 2026.
Chile's new Cybersecurity Agency began operations in March 2025, providing guidance during the transition. Until December 2026, ISPs operate under the older law with limited oversight.
