Yes. VPN use is fully legal in Bulgaria. There are no laws restricting individuals from using VPN services. Bulgaria operates under EU law (GDPR), national privacy legislation (the Personal Data Protection Act), and the Bulgarian Constitution (Article 32, which protects private life from interference, and Article 34, which protects the freedom and confidentiality of correspondence). As with any jurisdiction, activities illegal without a VPN remain illegal with one.
Bulgaria has one of the most contested data retention frameworks in the EU.
The Electronic Communications Act requires ISPs to retain traffic and location data for six months. Providers must report monthly on deleted data and submit annual statistics on disclosures to authorities. The Commission for Personal Data Protection (CPDP) oversees compliance.
In November 2022, the CJEU ruled in Case C-350/21 that Bulgaria's general and non-selective retention of traffic and location data is incompatible with EU law, even with the six-month limitation and existing safeguards. Earlier, in January 2022, the ECtHR found that Bulgaria's data retention laws do not meet the "quality of law" standard required by the European Convention on Human Rights.
In February 2024, Bulgarian MPs proposed amendments to align the law: 10 days of retention in unencrypted form plus 160 days in encrypted form using asymmetric encryption. As of April 2026, the amendment has not passed.
In November 2025, Bulgaria completed its Digital Services Act implementation, granting the CPDP new enforcement powers under Articles 51 and 56 of the DSA for supervising data processing activities.
